Introduction & Acceptance of Terms

Welcome to Ehsaan ("Ehsaan", "we", "our", or "us"), a consumer-to-consumer (C2C) online marketplace for pre-loved fashion, accessories, and lifestyle items, operated by Ehsaan Private Limited, a company registered in Pakistan.

By accessing or using the Ehsaan website (www.ehsaanapp.com) or mobile application (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Platform.

These Terms constitute a legally binding agreement between you and Ehsaan. We reserve the right to update these Terms at any time, and continued use of the Platform after changes constitutes your acceptance of the revised Terms.

Eligibility

To use Ehsaan, you must:

• Be at least 18 years of age, or have the consent of a parent or legal guardian.
• Be a resident of Pakistan or have the legal capacity to enter into a binding contract under Pakistani law.
• Provide accurate, complete, and current registration information.
• Not have been previously suspended or removed from the Ehsaan Platform.

User Accounts

To buy or sell on Ehsaan, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying Ehsaan immediately at hello@ehsaanapp.com if you suspect any unauthorised use of your account.

Ehsaan reserves the right to suspend or terminate any account that violates these Terms, is found to be fraudulent, or poses a risk to other users or the Platform.

Buying on Ehsaan

When you purchase an item on Ehsaan, you are entering into a direct transaction with the seller. Ehsaan acts solely as an intermediary platform and is not a party to the transaction.

Payment

All payments must be made through the Ehsaan Platform. Payments made outside the Platform are not covered by Ehsaan's Buyer Protection Policy. Payment is processed at the time of purchase.

Confirmation Window

Upon delivery, buyers have 48 hours to either confirm receipt and satisfaction, or raise a dispute. If no action is taken within 48 hours of confirmed delivery, the payment will be automatically released to the seller.

Prohibited Conduct

• Buyers must not attempt to transact with sellers outside the Platform.
• Buyers must not file false or fraudulent disputes.
• Buyers must not engage in chargebacks except in genuine cases of fraud.

Selling on Ehsaan

By listing an item on Ehsaan, you represent and warrant that:

• You are the lawful owner of the item or have the right to sell it.
• The item is accurately described, including any defects, signs of wear, or alterations.
• The item is not prohibited under these Terms or applicable Pakistani law.
• All photographs are of the actual item being sold.

Prohibited Items

The following items may not be listed or sold on Ehsaan:

• Counterfeit, replica, or trademark-infringing goods.
• Items that are illegal under Pakistani law, including but not limited to narcotics, weapons, and stolen property.
• Hazardous materials or substances.
• Underwear, swimwear, or intimate apparel (unless brand new with tags).
• Items that violate third-party intellectual property rights.
• Any item whose sale is prohibited by regulatory authorities in Pakistan.

Seller Fees

Ehsaan charges the following fees to sellers:

• Platform Fee: A fixed fee of Rs. 100 per order, shared equally: Rs. 50 is deducted from the seller at the time of payout and Rs. 50 is paid by the buyer at checkout. The current rate is always shown on the Fees and pricing page (www.ehsaanapp.com/pricing).
• Ad Boosting Fee: An optional one-time fee when a seller chooses to promote a listing: Rs. 250 for 3 days or Rs. 500 for 7 days in Karachi; Rs. 350 for 3 days or Rs. 700 for 7 days across Pakistan.

All fees are inclusive of applicable taxes where required by Pakistani law.

Shipping Obligations

Upon a confirmed sale, the seller must arrange for the drop-off of the item within 3 business days. Failure to ship within the required timeframe may result in automatic cancellation and a refund to the buyer, and may result in account suspension.

Platform Fees Charged to Buyers

In addition to the item price, buyers may be charged:

• Escrow Fee: 5% of the item price, which holds the payment safely until the buyer confirms delivery and insures the buyer against non-delivery or an item significantly not as described.
• Pickup and Delivery Fee: A flat Rs. 320 per order.
• Platform Fee (buyer's share): Rs. 50 per order, half of the Rs. 100 platform fee.

All applicable fees are clearly disclosed at checkout before payment is confirmed.

Prohibited Conduct

All users agree not to:

• Use the Platform for any unlawful purpose or in violation of Pakistani law.
• Post false, misleading, or deceptive listings.
• Harass, threaten, or intimidate other users.
• Attempt to manipulate prices, reviews, or platform algorithms.
• Use automated tools, bots, or scripts to access or scrape the Platform without written consent.
• Attempt to circumvent any security features or payment systems of the Platform.
• Engage in money laundering or other financial crimes through the Platform.

Intellectual Property

All content on the Ehsaan Platform, including but not limited to the logo, design, text, and software, is the property of Ehsaan and is protected under Pakistani intellectual property law. Users may not reproduce, distribute, or create derivative works without express written permission.

By uploading content (photos, descriptions) to the Platform, you grant Ehsaan a non-exclusive, royalty-free, worldwide licence to use, display, and promote that content on the Platform and in marketing materials.

Limitation of Liability

Ehsaan is a marketplace platform and is not responsible for:

• The accuracy, quality, safety, or legality of items listed on the Platform.
• The ability of sellers to sell items or buyers to pay for items.
• The conduct of any user on or off the Platform.
• Losses arising from transactions conducted outside the Ehsaan Platform.

To the maximum extent permitted by Pakistani law, Ehsaan's total liability to any user for any claim arising out of or in connection with these Terms shall not exceed the amount paid by or to that user in the relevant transaction.

Dispute Resolution

In the event of a dispute between a buyer and a seller, users are encouraged to first attempt to resolve the matter directly through the Ehsaan in-app messaging system. If a resolution cannot be reached, either party may escalate the dispute to Ehsaan's Resolution Centre within the Platform.

Ehsaan's decision in any dispute is final and binding. Ehsaan reserves the right to reverse transactions, issue refunds, or suspend accounts as it deems appropriate.

These Terms are governed by the laws of Pakistan. Any disputes that cannot be resolved through Ehsaan's internal process shall be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan.

Termination

Ehsaan reserves the right to suspend or permanently terminate any user account at its sole discretion, with or without notice, for any violation of these Terms. Users may close their account at any time by contacting hello@ehsaanapp.com. Any outstanding transactions at the time of termination will be handled in accordance with these Terms.

Changes to These Terms

Ehsaan may update these Terms from time to time. We will notify registered users of material changes via email or in-app notification. Continued use of the Platform after notification constitutes acceptance of the revised Terms.
